BAJANTHRI ORAL ORDER 16-12-2022 The matter is heard through video conferencing. In the instant petition petitioner has sought for regular bail under Section 439 of the Cr.P.C. in connection with Khudwa P.S. Case No. 08 of 2022, instituted for offences punishable under Sections 341, 323, 307, 302, 504, 506/34 of the Indian Penal Code read with Sections 25(1-b)a, 27 and 35 of Arms Act.

The alleged offence is taken place at about 7.30 PM on 06.02.2022 in a Chawmin Shop.

Perusal of the antecedent of the petitioner, it is evident that petitioner is involved in more than four criminal cases. The same has been recorded by the I/C Additional District & Sessions Judge XII, Aurangabad, Bihar. Prima facie petitioner is

Patna High Court CR. MISC. No.49633 of 2022(2) dt.16-12-2022 2/2 a habitual offender, therefore, it is pre-mature to release him on regular bail. Hence, petitioner has not made out a case. Accordingly, the present bail application of the petitioner is dismissed.
