JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to prosecution case itself, the informant had not seen the petitioner planting bombs nor anything was recovered either from conscious possession of the petitioner or from his house. The informant came to know about name of the petitioner from a reliable source but in course of investigation, none of the prosecution witness claimed to have seen the petitioner planting bombs.

No doubt, petitioner carries criminal antecedent but in the present case, except suspicion, there appears to be nothing against the petitioner.

Patna High Court Cr.Misc. No.53944 of 2015 (2) dt.01-12-2015 2/2 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Roshanganj P.S. Case No. 33 of 2014 to the satisfaction of Sri Abhay Srivastava, Judicial Magistrate-Ist Class, Sherghati, Gaya.
