Petitioner seeks regular bail in connection with Minapur P.S. Case No. 322 of 2017 registered for the offences punishable under Sections 302 of the Indian Penal Code. There is allegation against the petitioner of causing the death of the aunt of the informant and he was arrested and later on he was named in FIR.
Submission of learned counsel for the petitioner is that he was not arrested on the spot and he was made accused only on suspicion. There is no eye witness of the occurrence. Furthermore, he is in custody for more than two years. Heard learned APP also.
Informant has opposed the prayer for bail on the
Patna High Court CR. MISC. No.51897 of 2019(5) dt.02-03-2020 2/2 ground that he is named in FIR. There is allegation against the petitioner for murdering the aunt of the informant. Moreover, out of five witnesses, three witnesses have been examined and as such the trial is in progress.
Considering the above, I am not inclined to grant the bail to the petitioner. However, learned trial court is directed to expedite the trial and try to conclude it within a period of six months. Both the parties have to cooperate the disposal of the trial. At the same time SSP, Muzaffarpur is directed to produce the witnesses in the Court on the date fixed so that the trial may be concluded within the period as prescribed. Accordingly, this application is dismissed.
