Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
One cartridge each, some cash and mobile sets are said to have been recovered from conscious possession of petitioners when they were allegedly, fleeing after committing the loot.
Learned counsel for the petitioners submits that for the occurrence of loot, a separate case has been registered and so far as present case is concerned; except the cartridge, no fire-arm has been recovered from conscious possession of petitioners. It is
Patna High Court Cr.Misc. No.56959 of 2015 (2) dt.17-12-2015 2/2 further pointed out by him that moreover, prior to institution of the present case as well as Hathidah P.S. Case No. 50 of 2014, petitioners had not been made accused in any criminal case. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioners named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Hathidah P.S.
