This is a petition for grant of anticipatory bail for offence under Sections 272 and 273 of the Penal Code and 47(A) of the Excise Act.
The learned counsel for the petitioner submits that the name of the petitioner finds place in the first information report on the basis of the statement made by the alleged pillion rider on the motorcycle and it is alleged that a gunny bag was thrown out from the motorcycle, which contained country made wine. It is submitted that earlier raid conducted in the shop of Krishna Singh. The learned counsel for the petitioner submits that the petitioner is not related with Krishna Singh.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with the Karakat P.S. Case No. 75 of 2014 to the satisfaction of Sri Amit Kumar, Judicial
Patna High Court Cr.Misc. No.33344 of 2014 (2) dt.06-02-2015 2/2 Magistrate, 1st Class, Bikramganj, Rohtas, subject to the conditions laid down under Section 438(2) of the Criminal Procedure Code and the petitioner will cooperate with the police during investigation and shall produce himself as and when will be required by the police.
