The petitioner seeks bail in Sessions Trial No. 313/2014 arising out of Darauli P.S. Case no. 107/2013 registered for the offence punishable under Sections 366A, 384/34 of the Indian Penal Code.

Earlier, the prayer for bail of the petitioner was rejected by the Court vide order dated 04.09.2015 passed in Cr. Misc. 38373/2015 with a direction that the petitioner may renew his prayer for bail after examination of the victim. It is submitted that the victim Rajnandani Kumari was examined and she did not support the prosecution case. Deposition of Rajnandani Kumari is annexure 3.

Considering the facts aforesaid and the fact that the

No.54744 of 2015 (2) dt.27-04-2016 2/2 victim did not support the prosecution case, petitioner abovenamed is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Adhoc Addl.
