12-10-2018 It seems to be a totally frivolous application by making false statement in the very first paragraph of the application where the petitioner has stated that by order dated 01.10.2016 and 19.10.2016 learned Judicial Magistrate has framed charges against the petitioner under Section 498A of the Indian Penal Code. The order dated 01.10.2016 simply records as under: - "As per DJs order no. 185 dated 19.09.16 case record has been transferred from the court of Sri R.K. Rajak, J.M. 1st Class, Benipatti next date fixed 30.03.2017." There is no order on record for framing of charge in the present case.
This application is dismissed.
Patna High Court Cr.Misc. No.22074 of 2017 (2) dt.12-10-2018 In normal circumstance, the court could have imposed heavy cost against the petitioner, but considering that he has filed this case on wrong advice the court is restraining itself of imposing such cost.
