Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273/34 of the Indian Penal Code and Section 30(a)/38(1),41(1) of the Bihar Prohibition and Excise Act, 2016.
2000 liters of liquor was recovered form a truck. The petitioner and others were seen nearby the said truck and they were suspected to be involved. Petitioner has got identical criminal antecedent.
Submission is that co-accused-Dhirendra Kumar @ Dhiran has already been allowed bail by a Coordinate Bench of this Court vide Annexure-2.
Considering the nature and seriousness of the
Patna High Court CR. MISC. No.47253 of 2019(2) dt.01-08-2019 2/2 allegation, let the petitioner, above named, be released on bail if the trial is not concluded within six months from the date of framing of the charges on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Turkauliya Police Station Case No.50 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
