The petitioner seeks bail in connection with Ara Muffasil P.S. Case No. 101 of 2021 instituted for the offences under Sections 379 and 411 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 25.04.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that he after parking his motorcycle went to attend housewarming (grih pravesh) and when he came out his motorcycle was missing. Further, it is alleged that the informant was informed that the petitioner was seen driving the motorcycle and was going towards Udmanpur, accordingly it is

Patna High Court CR. MISC. No.59561 of 2021(2) dt.09-03-2022 2/2 alleged that the informant also went to Udmanpur and found his bike parked outside the house of one Santosh Pathak. Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R. it would manifest that the informant does not disclose in the F.I.R. that who gave him the information that the petitioner was seen driving the motorcycle. It is further submitted that the motorcycle has been recovered and the petitioner was not found at the place of occurrence.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case and in the nature of allegations, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Bhojpur at Ara in connection with Ara Muffasil P.S. Case No. 101 of 2021.
