The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149,332, 323, 307, 353, 427 and 379 of the Indian Penal Code. Prosecution case is that the informant being SubInspector of Police during night patrolling found some people gambling when the dead body of one Saddam Alam @ Sonu was recovered from the pond. Subsequently, the mob got infuriated and pelted stones causing injury to the police personnel. It is submitted by learned counsel for the petitioners that in fact due to assault made by the police Saddam Alam @

Patna High Court Cr.Misc. No.4632 of 2016 (2) dt.04-02-2016 2/2 Sonu died when the mob made protest then the present case has been lodged by the police to save their own skin. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Raxaul at Motihari, East Champaran in connection with Raxaul P.S. Case No.270/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
