The petitioners seek regular bail in connection with Teghra P.S. Case No. 244 of 2021, registered for the offence punishable under sections 30(a), 41(1)(2) of Bihar Prohibition and Excise (Amendment) Act, 2018.
The allegation is regarding recovery of huge quantity of illicit liquor from a truck and alto car and the petitioners are stated to have been arrested from the spot.
The learned counsel for the petitioners has submitted that the petitioners are innocent, have

The learned counsel for the petitioners has referred to Paragraph No. 9 of the present petition to submit that the petitioners are having no concern either with the seized vehicles or the seized illicit liquor and they have been falsely made accused in the present case.
Per contra, the learned APP for the State, has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the parties and taking into account the materials available on record as also considering the fact that neither the illicit liquor has been recovered from the conscious possession of the petitioners nor the vehicles in question are stated to be belonging to the petitioners, as has been stated in paragraph No. 9 of the present petition, I deem it fit and proper to admit the petitioners to the privilege of regular bail. Accordingly, the petitioners, above named,
Patna High Court CR. MISC. No.60100 of 2021(2) dt.29-03-2022 3/3 are directed to be released on bail on furnishing bail- bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned court of Additional District Judge-II-cumSpecial Judge, Excise Act, Begusarai in connection with Teghra P.S. Case No. 244 of 2021.
