This application is for grant of regular bail in connection with S.Tr. No.447 of 2018 arising out of Daraunda PS Case no.18 of 2017 for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner and other coaccused persons is of firing on the deceased and the postmortem report finds three wounds of entry and three wounds of exist. Petitioner is in custody for about three years and it is submitted that 11 witnesses have been examined by the learned trial court and similarly situated person has been granted bail by a Co-ordinate Bench of this Court, vide order dated 11.12.2019 passed in Cr. Misc. No.46195 of 2019.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner , however, this application is disposed of with a direction to the petitioner to make an application before the learned trial court, who will consider the materials available against the petitioner at this stage and will pass appropriate order keeping in mind that one of the co-accused has been granted bail by this Court.
