The petitioner apprehends his arrest in connection with Town P.S. Case No. 367 of 2018 registered under Sections 272, 273 of I.P.C. and section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that the alleged recovered vehicle is a commercial vehicle. There is no statement of driver regarding the ownership of alleged vehicle in the first information report. It is also submitted that petitioner has no criminal antecedent.

Case No. 367 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
