2. The petitioner has preferred this application for grant of regular bail in connection with Patahi P.S. Case No. 101 of 2024 dated 04.05.2024 registered for the offence/s punishable u/ss 147, 148, 149, 341, 323, 324, 307, 379, 504, 506 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have come to the door of the informant and started assaulting the informant, his brother and his father with Lathi and sword causing injuries to them and they also snatched golden chain from Kokil Kumar.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.54242 of 2024(2) dt.19-08-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. There is land dispute between the parties for which a title suit no. 483 of 2017 is pending in the court of the learned Sub Judge-III, Motihari, East Champaran. As per annexure-2 filed on behalf of the petitioner, the injured sustained simple injuries caused by hard and blunt substance. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 07.05.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sadar, Motihari, East Champaran in connection with Patahi P.S. Case No. 101 of 2024.
7. The application stands allowed.
