JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This is an application for grant of anticipatory bail in connection with Sheohar P. S. Case No. 48 of 2019, disclosing offences under Sections 307, 323, 34, 341, 436 and 506 of IPC. As per F.I.R. there is allegation against the petitioner and other accused persons that they set the cattle house of the informant on fire, due to which, some cattles were burnt. Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner, due to earlier altercation took between the parties, he has falsely been implicated in this case.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail and submitted that the proclamation has been made, but it appears that proclamation has been issued during the pendency of this application of the petitioner before
Patna High Court CR. MISC. No.46609 of 2019(4) dt.15-11-2019 2/2 the court below and before this Court.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Sheohar, in connection with Sheohar P. S. Case No. 48 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
