JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 363, 366(A), 365/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons kidnapped the minor daughter of informant for illicit purposes.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. As a matter of fact this petitioner and the victim girl are co-villager and there was love affair between them which was not liked by the father of victim and, therefore, they decided to go to Delhi to solemnize marriage and Mama of victim received them at Delhi and kept them in his house. Patna High Court CR. MISC. No.59988 of 2021(3) dt.24-03-2022 2/2 statement u/s 164 of the Cr. P. C. disclosed her age to be 17 years and she did not allege any allegation of sexual assault against this petitioner. Petitioner claims clean antecedent and is in custody since 30.06.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, West, Muzaffarpur in connection with Saraiya PS case No.450/2021.
