This application for grant of anticipatory bail arises out of SC/ST Harijan P.S. Case No. 142/15, disclosing offences under sections 341, 323, 504, 506, 34 of the Indian Penal Code and 3(1)(x) of the SC & ST Prevention of Atrocities Act. Considering the fact that on the basis of allegation, as contained in the First Information Report, offence under section 3(1)(x) of the SC & ST Prevention of Atrocities Act is made out, in my considered opinion, this application for anticipatory bail cannot be entertained.
It is, accordingly, rejected.
The petitioners are directed to appear before the court
Patna High Court Cr.Misc. No.6043 of 2016 (2) dt.24-02-2016 below within four weeks from today and seek regular bail, if so advised. If they do so, the court below shall consider the application on its own merit, preferably on the same day, without being prejudiced by rejection of the present application for anticipatory bail.
