The petitioner apprehends his arrest in connection with Complaint Case No.C-2/182 of 2019 registered under Section 30(A) of the Bihar Prohibition and Excise Act, 2016, pending in the court of the Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Sitamarhi. The accusation is that on receiving secret information, the informant along with other Excise officials made raid at village-Dhobauli, where a motorcycle loaded with sack was found in standing condition and sack was also found near the motorcycle. On seeing the informant and other Excise officials, one person succeeded to flee away. On search of the

Patna High Court CR. MISC. No.47162 of 2019(2) dt.30-07-2019 2/2 motorcycle, owner book of the motorcycle, which was in the name of the petitioner, was recovered. On search of both the sacks, several bottles of Indian Made Foreign Liquor in volume of 182.340 liters were recovered.

Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
