JUSTICE ARUN KUMAR ORAL ORDER 24-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 19.2.2018, seeks bail in Bhabua PS Case No. 638 of 2017 registered under Sections .. of the IPC.

The allegation in brief is that two FIR named accused persons along with two unknown persons came to the coaching institute of the informant and made demand of extortion of fifty thousand rupees and the two FIR named accused persons also used to give message asking for extortion from their respective mobile numbers mentioned in the FIR.

Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, his name was disclosed in the confessional statement of Munna Yadav, FIR named accused, except that there is no other material, he was also not put on TIP, he has one criminal antecedent of Arms Act but in that case there is no recovery of any fire arm from his possession, another case was lodged by the informant for extortion against the two FIR named accused and this petitioner was also implicated in that case, except these two cases he

Patna High Court Cr.Misc. No.24199 of 2018 (2) dt.24-04-2018 has no other criminal antecedent and he is in custody since 19.2.2018.

Having considered the said facts and circumstances, the petitioner, namely, Deepak Patel @ Daini Patel @ Daini is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Kaimur (Bhabua) in connection with Bhabua PS Case No. 638 of 2017 with the following conditions:- (i) one of the bailors shall be a close family member of the petitioner; and (ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
