16-12-2015 Heard Sri Ashok Kumar Pandey, learned counsel for the petitioner, Mr. Akbar Ali, learned Addl. Public Prosecutor and Sri Lal Bahadur Singh, learned counsel, who has voluntarily appeared on behalf of informant.

The petitioner, who is in custody since 24-09-2015 in Dihri (Indrapuri) P.S. Case No. 320 of 2015 registered for the offence under Sections 406, 420 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act, 1881, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that in a civil dispute, colour of criminal offence has been given and the petitioner has been taken into custody. It has been argued

Patna High Court Cr.Misc. No.53008 of 2015 (2) dt.16-12-2015 2/2 that main allegation is issuance of cheques by the petitioner, which were dishonored by the bank.

Learned counsel for the informant and learned Addl. Public Prosecutor have opposed the prayer for bail. Learned counsel for the informant submits that the petitioner may be released after refund of the amount claimed in the F.I.R. Be that as it may, keeping in view the nature of accusation and period of custody, let the petitioner namely Jawahar Prasad Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Divesh Kumar, J.M. Ist Class, Dehrion-Sone, Rohtas at Sasaram/concerned court in connection with Dihri (Indrapuri) P.S. Case No. 320 of 2015.
