The petitioner seeks bail in connection with Kurhani P.S. Case No.365 of 2015 registered under section 387 of the Indian Penal Code.
It has been contended that the petitioner is innocent and mobile number in question was issued by the service provider on the basis of fake identity proof of the petitioner. On the other hand, learned counsel for the State has contended that during investigation the petitioner has disclosed that he had demanded ransom from the informant and threw the Sim card into a river.
Regard being had to the facts and circumstances of the
Patna High Court Cr.Misc. No.52992 of 2015 (4) dt.05-02-2016 2/2 case, the prayer for bail of the petitioner is rejected for the present. The Judicial Magistrate, 1st Class, Muzaffarpur, who is dealing with Kurhani P.S. Case No.365 of 2015, is directed to frame charge and proceed with the trial on day-to-day basis and conclude the same as early as possible preferably within six months from the date of receipt/production of a copy of this order failing which the petitioner would be entitled to renew his prayer for bail before the Court of Magistrate itself. In that circumstance, the learned Magistrate must assign reason as to why the trial could not be concluded within the stipulated period while disposing of the bail petition.
