JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2016 Heard learned counsels for the petitioner and the State. The petitioner, being the co-villager of the husband of the victim, is apprehending arrest in a case registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.
The accusation is of killing the sister of the informant after eight year of the marriage by cutting her neck when suspicion was raised against the entire in-laws family including the petitioner.
It is submitted by learned counsel for the petitioner that only on suspicion, the petitioner has been roped in this case and he is co-villager of the husband of the victim. It is further submitted by learned counsel for the petitioner that considering the materials collected during investigation particularly in paragraph nos. 22, 23
Patna High Court Cr.Misc. No.7400 of 2016 (2) dt.19-02-2016 2/2 and 24 of the case diary that the injury on the neck of the victim was caused by the father-in-law with the help of another coaccused Mahadev Nayak and Amlesh Nayak, they have been granted anticipatory bail vide Cr. Misc. No. 41981 of 2014. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Supaul in connection with Marauna P.S. Case No. 122 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
