JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody since 1612-2014 in a case registered under Sections-8, 20, 22 of NDPS Act.
Forty kg. Ganja, kept in four bags were recovered on a berth of a train and allegedly, it is stated that petitioner was sitting on the said berth.
Learned counsel for the petitioner submits that petitioner was caught by the police officials on mere suspicion and as a matter of fact, there is nothing in the entire case diary except so called confessional statement of petitioner, to show that the aforesaid recovery was made from possession of the petitioner. It
Patna High Court Cr.Misc. No.34990 of 2015 (3) dt.10-11-2015 2/2 is further contended by him that the petitioner does not have any criminal antecedent.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Khagaria Rail P.S. Case No. 33 of 2014 corresponding to Special Case No. 10 of 2014, G.R.(R) No. 117 of 2014 to the satisfaction of learned Additional District & Sessions Judge-I, Khagaria.
