Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 342, 323, 302 and 120B/34 of the Indian Penal Code.

According to FIR, the victim son of the informant had gone along with the petitioner elsewhere. For that reason, family members of the petitioner had threatened to kill the son of the informant. Allegation is that all the FIR named accused persons including the petitioner bitterly assaulted to the son of the informant as a result whereof he died.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely dragged in this case. She had love affairs with the deceased that is why murder after assault to the deceased might have been committed.

Patna High Court Cr.Misc. No.11811 of 2018 (3) dt.16-04-2018 2/2 Petitioner is in custody since 20.09.2017. Investigation of the case is already complete and petitioner is ready to cooperate with the trial.

Learned counsel for the informant opposed the prayer for bail for the reason that the eye-witnesses have supported the allegation that the deceased was being assaulted in the house of the petitioner by other named accused persons including the petitioner, as a result of assault he died. The Doctor has found multiple injuries including fracture of rib on the person of the deceased.

Considering the general and omnibus nature of allegation as well as the fact that the petitioner is a female, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sathi Police Station Case No. 137 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
