The petitioner, who is the husband of opposite party no. 2, seeks bail in anticipation of his arrest in connection with Complaint Case No. 807C of 2018 in which cognizance has been taken under Sections 323, 498(A) and 406 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

At the outset, learned counsel for the petitioner submitted that he is ready to settle the matrimonial differences with his wife and restore the matrimonial relationship.

With this stand of the petitioner, this Court

Patna High Court CR. MISC. No.47330 of 2019(8) dt.02-11-2020 2/2 directs that in the event of the petitioner surrendering before the court below within a period of eight weeks, he shall be released on provisional bail.

The court below shall notice the informant/opposite party no. 2 and on her appearance, shall explore the possibilities and decide the modalities of the restitution of conjugal rights. If this is not possible, the court will also consider the possibility of a one time settlement if it is agreeable between the parties.

If the issue is resolved, the provisional bail granted to the petitioner shall be confirmed by the court below. If for some reason or the other, the conduct of the opposite party no. 2 would not appear to be reasonable to the court below, that shall be taken into account while confirming the provisional bail of the petitioner.

The petition stands disposed of accordingly.
