====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 19-08-2023 Heard learned Counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner is apprehending his arrest in connection with Mokama P.S. Case No.71 of 2023 dated 21.02.2023, lodged under Section 392 of the Indian Penal Code.

3. As per prosecution case, the F.I.R. has been lodged against four unknown accused persons stating that they are sitting in a white Maruti car.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. He further submits that name of petitioner has come on the basis of confessional statement of the co-accused Kishan Kumar @ Suraj Kumar before the Police. He also submits that there is no material found against the petitioner.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that it is a case of robbery on National Highway, antecedent of petitioner is not clean as there re four criminal cases pending against him.

6. In the present facts and circumstances and the submissions made above, this Court is not inclined to extend the privilege of anticipatory bail to the petitioner in connection with Mokama P.S. Case No.71 of 2023 to the satisfaction of learned A.C.J.M.-III, Barh, Patna.

7. Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.

8. However, the learned Court below shall consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of four weeks.

9. The present order shall not cause any prejudice to the petitioner.
