The petitioner seeks bail in Dulhin Bazar P.S. Case No. 190 of 2017 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act One country made musket rifle is said to have been recovered from the trunk kept in the bedroom of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. The house from where the arm is said to have been recovered is inhabited by several family members of the petitioner. No cartridge has been recovered from the possession of the petitioner. Patna High Court Cr.Misc. No.20696 of 2018 (2) dt.11-04-2018 2/2 languishing in custody since 09.08.2017. Earlier bail prayer of the petitioner was rejected by this Court vide order dated 09.11.2017 with liberty to renew his prayer for bail after four months or framing of charge whichever happens earlier. Charge in the case has not yet been framed rather four months have passed from the date of the aforesaid order.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Danapur, Patna in connection with Dulhin Bazar P.S. Case No. 190 of 2017.
