This application has been filed for modification of the order dated 15.9.2016 passed in Cr. Misc. No.17420 of 2016. Learned counsel for the petitioner submits that there is some error in the order and has stated that petitioner has deposited the money before lodging of the case. It is matter of record. It can be verified by looking to the records by the court below. So far there is no material in the case diary, the same will be seen by the court below at the time of framing of charge.

It goes without saying that petitioner will be at liberty to raise the points before the court below.
