====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 12-11-2025 Heard learned Advocate appearing on behalf of the petitioner and the learned Additional Public Prosecutor for the State.

2. The petitioner apprehends his arrest in connection with Halai P.S. Case No. 72 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117(2), 109(1), 74, 303(2), 352, 351(2)(3) and 34 of the Bharatiya Nyaya Sanhita.

3. Allegedly all the FIR named accused persons alongwith the petitioner brutally assaulted the informant and his mother as well as sister by means of lathi, danda and kudal, due to which they sustained serious injury. There is a specific allegation that the co-accused Himanshu Kumar alongwith the petitioner and one Anmol Kumar made repeated blow of iron

Learned Advocate appearing on behalf of the petitioner submitted that besides the omnibus nature of allegation against three named accused persons, the treatment of the injured was done in a private hospital and the manipulation in the injury report cannot be ruled out. There is a counter version of the present occurrence being Halai P.S. Case No. 74 of 2025 instituted by the member of the petitioner's side against the informant and his family members. The petitioner is a man of fair antecedent and he undertakes that he will fully cooperate in the proceeding of the Court.

5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submits that the injury which is sustained to be mother of the informant is found to be grievous in nature and the same is attributed to the petitioner with other persons.

Regard being had to the submissions made on behalf of the parties and considering the omnibus nature of allegation, coupled with the factum of case and counter case as well as the fair antecedent of the petitioner, let the petitioner above named be released on bail, in the event of his arrest or

No.47958 of 2025(3) dt.12-11-2025 3/3 surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sahpur Patori, District Samastipur in connection with Halai P.S. Case No. 72 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
