JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by learned counsel for the petitioner that the petitioner is the mother of Manoj Gupta with whom the complainant claims to have married. The case of the petitioner is that the son of the petitioner Manoj Gupta was married after death of his first to Jyoti Kumari, the elder sister of the complainant but Jyoti Kumari does not want to resume conjugal life since the petitioner has five children from the first wife.

No.3917 of 2016 (2) dt.27-01-2016 2/2 Considering the thrust of accusation against the husband of the complainant, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Kaimur at Bhabua in connection with Complaint Case No. 791 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Learned counsel for the petitioner is permitted to make necessary correction in the petition.
