The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 143, 341, 504, 506, 353, 188 of the Indian Penal Code. The prosecution case is that the police interrogated the brother of the informant in Pipra P.S. Case No. 147 of 2015 levelling accusation under Section 366A/34 of the Indian Penal Code, where the road was blocked, slogans were raised and the mob misbehaved with the police.
It is submitted by the learned counsel for the petitioner that First Information Report was lodged after 24 hours of the occurrence. Accusation is against the mob. Statement has been made in para-3 of the petition that
Patna High Court Cr.Misc. No.3895 of 2016 (2) dt.27-01-2016 petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Jitendra Kumar, J.M., Ist Class, Supaul in connection with Pipra P.S. Case No. 148 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
