2. The petitioner is apprehending his arrest in connection with Mednichowki P.S. Case No. 07 of 2023 registered for the offences punishable under Sections 25(1-b)a, 26, 27, 35 of the Arms Act and Section 37 (b) (c) of the Bihar Prohibition and Excise Act 2018.

3. As per the prosecution case, there was dispute between two group in which there was firing going on and when the police reached on the spot all the accused persons including the petitioner fled away. On search, three mis-fired cartridges were recovered from the pocket of co-accused Amit Kumar Jha.

4. Learned counsel for the petitioner submits that

No incriminating article was recovered from possession of the petitioner. No source of information has been disclosed by the prosecution party for naming the petitioner as accused. The petitioner has falsely been implicated in three other cases also in which he is on bail.

5. Learned APP opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Mednichowki P.S. Case No. 07 of 2023, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, subject to the conditions as follows:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
