On account of presence of VVIP to participate in 'Urs', the informant directed Chaukidar to stop their religious procession and during course thereof, there was wrong notion with regard to diversion of rout of the processionist whereupon persons of two religious group indulged in an altercation followed with brick-batting and then the mob became unruly damaged the Government's property as well as property belonging to private persons, indulged in arson. Furthermore, informant identified the persons of both the communities including the petitioner. There happens to be absence of specific allegation against the petitioner coupled with absence of criminal antecedent as disclosed under para-3 of the petition and being under custody
Patna High Court Cr.Misc. No.5827 of 2018 (2) dt.01-02-2018 since 11.12.2017.
Accordingly, petitioner, Sanjit @ Sanjit Kumar @ Jaunty is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XV, Patna, in Phulwari Sharif PS Case No. 772/2017.
