Mr.Raj Kishor Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 31-08-2024 Heard the learned counsel for the petitioner and learned APP for the State.

2. This is the second attempt of the petitioner for grant of regular bail in connection with Kanti P.S. Case No. 113 of 2023 registered for the offence under Sections 25(1-B)a, 26 and Section 35 of the Arms Act.

3. As per the prosecution case, the petitioner is said to have been caught with one country made pistol.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 25.02.2023, he is quite innocent and has not committed any offence as alleged in F.I.R.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the allegations levelled against the

Patna High Court CR. MISC. No.56358 of 2024(2) dt.31-08-2024 2/2 petitioner and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, West, Muzaffarpur /concerned Court below in connection with Kanti P.S. Case No. 113 of 2023 subject to condition:- (i) The petitioner will mark his attendance at the Kanti Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

(ii) The petitioner is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
