JUSTICE RAMESH KUMAR DATTA ORAL ORDER 04-02-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners pray for anticipatory bail in a case registered under Sections 379 and 411 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are poor cooks of the school who are cooking the mid-day meal and are daily wagers. It is further submitted that there is no criminal antecedent. Learned counsel also submits that in the present matter the allegation is only with regard to 3 small bags of rice and the value of rice involved would not exceed 4-5 thousands rupees.
On a consideration of the facts and circumstances of the case and considering the fact that the petitioners are ladies,
Patna High Court Cr.Misc. No.33804 of 2014 (2) dt.04-02-2015 2/2 it is directed that the petitioners, (1) Most Kaushilya Devi @ Soshila Devi and (2). Sita Devi, in the event of their arrest/surrender in the court below within four weeks from today shall be released on bail on furnishing bail bonds of Rs. 5,000/- (five thousand) each with two sureties of the like amount each in connection with Piprahi P.S. Case No. 44 of 2014 to the satisfaction of the Chief Judicial Magistrate, Sheohar, subject to the conditions laid down under Section 438(2) Cr.P.C. (Ramesh Kumar Datta, J) S.Pandey/- U
