Out of two petitioners, petitioner no. 2 has already been granted privilege of bail and the prayer for bail of the petitioner no. 1 is pending.
Petitioner no. 1 happens to be husband of the deceased and according to the prosecution case, the marriage of petitioner was solemnized with the deceased three years ago and they were leading happy and peaceful life but, subsequently, petitioner no. 1 started demanding Rs. 50,000/- and one motorcycle in dowry and subsequently, committed murder of the deceased. Learned counsel for the petitioner no. 1 submits that no injury was found on the person of the deceased and the doctor
Patna High Court Cr.Misc. No.54438 of 2015 (5) dt.09-03-2016 2/2 could not ascertain the cause of death of the deceased and, moreover, the investigation has been completed and, therefore, there is no need to send the petitioner no. 1 behind the bar. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner no. 1, namely, Ghulam Mustafa, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S.case No. 214 of 2015.
