====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-01-2023 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.
Heard the learned counsel for the petitioner, the learned counsel for the informant and the learned APP for the State.
The petitioner apprehends her arrest in connection with Sabour P.S. Case No. 281 of 2021, registered for the offences punishable under Sections 341, 323, 494, 498 A, 504, 506 and 120 B of the Indian Penal Code and also Section 3 and 4 of Dowry Prohibition Act.
It is a case of matrimonial dispute. As per allegation,
Patna High Court CR. MISC. No.49883 of 2022(3) dt.16-01-2023 2/3 the accused persons subjected the informant to cruelty for non-fulfilment of demand of dowry.
The learned counsel for the petitioner has submitted that she is mother-in-law of the informant. She has no concern with day-to-day affairs of the couple. She lives separately from her son. She is a lady of clean antecedent. On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that the petitioner along with other family members of the husband of the informant subjected the victim to cruelty for non-fulfilment of the dowry demand.
Considering the above-mentioned facts and circumstances, let the petitioner, in the event of her arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,Bhagalpur in connection with Sabour P.S. Case No. 281 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided hereinabove,
