JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 302/34 of the Indian Penal Code. Prosecution case is that on 25.5.2015, the petitioner caused injury with the sickle on the left eye of the informant. Thereafter the husband of the informant took her to hospital while informant and her husband were returning the brother-in-law of the informant (Bdhainsur) Kishore Sahni slapped her husband. The husband of the informed being chased by Kishore Sahni tried to run away but he fell down then co-accused Kishore Sahni stabbed him. Subsequently, husband of the informant succumbed to the injury.
Patna High Court Cr.Misc. No.6456 of 2016 (2) dt.11-02-2016 2/2 It is submitted by learned counsel for the petitioner that there is no allegation against the petitioner. The petitioner was only alleged to have caused injury to the informant. The injury of informant has been found simple in nature caused by hard and blunt substance though accusation is of causing injury by sharp cutting weapon.
Statement has been made in paragraph-3 of the petition, petitioner has got no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No.338 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) N.H./- U T
