JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(a) of the Excise Act. The prosecution case is of recovery of 103 litres of Mahua liquor from the toddy shop of the petitioner. It is submitted by learned counsel for the petitioner that seizure list does not bear the signature of any family member of the petitioner. Hence, it suggests that actually no recovery was made from the petitioner. The seizure list reflects that the recovery has been made from the house and from the courtyard of the house.

Considering the nature of recovery, let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Wazirganj P.S. Case No. 406 of 2015,

Patna High Court Cr.Misc. No.4493 of 2016 (2) dt.02-02-2016 2/2 pending in the Court of learned Judicial Magistrate, 1st Class, Gaya.

With the observations above, the application stands disposed off.
