The petitioner seeks bail in connection with Sugauli P.S. Case No. 469 of 2020 instituted for the offences under Sections 143, 447, 341, 323, 448, 324, 307, 354(B), 379, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.06.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation against the petitioner is of assaulting the son of the informant Tunnu Ram with iron rod on his head causing injury. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, the

No.60263 of 2021(2) dt.10-03-2022 2/2 informant and the petitioners are related and are agnates and has drawn the attention of the Court to page '2' of the impugned order to show that the injury of Tunnu Ram was simple in nature and two lacerated wounds were on his head and pain in both hands and legs.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case, nature of injury is simple and the blow was not repeated, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Sugauli P.S.
