JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 22-02-2018 This application under Section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 02.05.2017 passed by the learned Additional District and Sessions Judge-1, Bagaha, West Champaran in Sessions Trial No.348 of 2008 (CIS No.2030 of 2014) arising out of Bagaha P.S. Case No.06 of 2005 dated 07.01.2005 whereby prosecution evidence has been closed without examination of the informant, investigating officer and the doctor.

After some arguments, Mr. Rakesh Kumar, learned counsel for the petitioner seeks leave to withdraw the present application in order to file an application under Section 311 of the

Patna High Court Cr.Misc. No.29710 of 2017 (2) dt.22-02-2018 2/2 Code of Criminal Procedure before the trial court. Leave is granted.
