2. The petitioner seeks regular bail in the present case registered for the offence under Sections 366, 363, 120B, 341, 504, 452 and 380 of the Indian Penal Code.

3. As per the prosecution case, petitioner is alleged to have kidnapped the victim girl.

4. Learned counsel for the petitioner submits that the victim in her statement recorded under Section 164 of the Cr.P.C., has submitted that she has eloped with the petitioner and got married to him. Petitioner is in custody since 30.11.2023.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge (POCSO Act), Darbhanga/concerned Court below in connection with Bishanpur /BishunpurP.S. Case No. 89 of 2023 subject to condition that:- 7(i) The petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court through his lawyer or through himself.
