JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner along with two others was caught while sitting in a vehicle and one country made loaded katta, rinch as well as other articles were recovered from a bag which was being carried by the petitioner.

The contention on behalf of the petitioner is that petitioner is a plumber and as a matter of fact, no firearm had been recovered from his conscious possession and so far as recovery of instruments is concerned, it is quite natural that petitioner being plumber had possessed the aforesaid instruments. Moreover, petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.56531 of 2015 (2) dt.14-12-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Brahampura P.S. Case No. 159 of 2015.
