JUSTICE ARUN KUMAR ORAL ORDER 09-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Jogbani PS Case No. 114 of 2017 registered under Sections 302, 380, 427, 323, 504 and 506 of the IPC.

The allegation in brief is that a complaint was filed against the petitioners after more than a month that they set fire on the daughter of the complainant as a result of which she sustained burnt injury and died during treatment.

Learned Counsel for the petitioner submits that as per the allegation date of occurrence is 10.6.2015, the girl was undergoing medical treatment and died on 23.6.2015 and she is said to have disclosed name of the accused persons but her statement was never recorded as information was not given to the police and after lapse of more than a month from her death the complaint was filed. The petitioners have clean antecedent.

Having considered the said facts and circumstances, the petitioners namely, Ranjit Yadav, Santosh Yadav and Sanjay Yadav are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the

Patna High Court Cr.Misc. No.8140 of 2018 (2) dt.09-02-2018 like amount each to the satisfaction of CJM Araria in connection with Jogbani PS Case No. 114 of 2017.
