2. The petitioner seeks regular bail in a case registered for the offence punishable under sections Section 47 (a) and 47 ( f ) of the Bihar Prohibition and Excise Act. 3 . It is alleged that 31.3 liters of English liquor was recovered from an orchard and two motorcycles were seized. Petitioner is owner of one of the seized motorcycles.
4. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case only on the basis of suspicion . Neither any incriminating article has been recovered from from seized motorcycles nor from the conscious possession of petitioner and he has got no concern with the alleged occurrence . Patna High Court CR. MISC. No.48688 of 2025(2) dt.17-07-2025 2/2 criminal antecedent in which he is on bail. Charge sheet has already been submitted. Petitioner is in custody since 16.06.2025 .
5 . Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned special Judge Excise - I Samastipur in connection with Karpurigram P. S. Case No. 28 of 2025 .
