JUSTICE ARUN KUMAR ORAL ORDER 20-04-2018 Heard learned Counsel for the petitioners and the State. Petitioner, already in custody since 29.1.2018, seek bail in Yogapatti (Nawalpur) PS Case No. 53 of 2018 registered under Sections 376, 201, 120B of the IPC and Section 4 of Pocso Act. The allegation of committing rape of ten years old child is against Sunny @ Ghughli, son of these two petitioners, the allegation against the petitioners is that when the rapist escaped away on raising alarm the family members and the petitioners came and on seeing condition of the girl brought her to the clinic of a private doctor.
Learned Counsel for the petitioners submits that allegation of committing rape is against son of the petitioner and the petitioner never tried to save their son but seeing condition of the girl brought her for medical treatment.
Having considered the said facts and circumstances since the allegation of committing rape is against Sunny, the petitioners, namely, Mahendra Chaudhary and Binda Devi are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten
Patna High Court Cr.Misc. No.23843 of 2018 (2) dt.20-04-2018 thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge Ist -cum- Special Judge Bettiah, West Champaran in connection with Yogapatti (Nawalpur) PS Case No. 53 of 2018.
