Petitioner seeks bail in a case registered for the offences punishable under Sections 393,307 of Indian Penal Code.

Perused the explanation of the Chief Judicial Magistrate, Katihar.

The same is accepted.

Submission is that the FIR is against unknown. The petitioner is in custody since 20.01.2020, however, he was never put on T.I.Parade during investigation of the case nor any incriminating article was recovered from his possession. Only due to criminal antecedent, the petitioner has been booked in this case in arbitrary manner by the police.

Since there is lack of material against the petitioner in this case for further detention as undertrial prisoner, let the

No.6846 of 2021(4) dt.24-07-2021 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Korha Police Station Case No.486 of 2019 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
