2. Petitioner is in custody in connection with Parihar P.S. Case No-161/2026 registered for the offences punishable under Sections 317(5), of the B.N.S and 30(a) of the Bihar Prohibition and Excise Act.
3. As per the allegation in the FIR, total 126 litres illicit Nepali liquor was recovered from the jute bags which were kept on motorcycles.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that nothing has been recovered from the conscious possession of the petitioner. He further submits that the name of the petitioner has been dragged in this case on
Patna High Court CR. MISC. No.50111 of 2026(2) dt.22-07-2026 2/2 the basis of suspicion. He further submits that the petitioner has no concern with the recovered liquor. He next submits that the petitioner is in custody since 07.06.2026 and he has got two criminal antecedents as per paragraph 3 of the bail petition, in which he is on bail.
5. Learned APP appearing on behalf of the State vehemently opposes the prayer for bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case and also submission of learned counsel for the petitioner, let the above named petitioner be released on bail, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Court-I, Sitamarhi in connection with Parihar P.S. Case No-161/2026.
