This is a petition for grant of regular bail in a case under Sections 302 and 201/34 of the Indian Penal Code. It is alleged that the daughter of the informant was married with the son of Lobin Biswas petitioner no.1, but due to some difference, the daughter of the informant and son-in-law were living in the house of the informant. It is further alleged that on 14.08.2013 the daughter of informant was sleeping with the daughter of the brother of the informant on machan and in the morning, the daughter of the brother of the informant did not find the daughter of informant, who stated that the son-in-law of petitioner no. 1 Lobin Biswas, namely, Nilambar Biswas had
Patna High Court Cr.Misc. No.54216 of 2015 (3) dt.11-02-2016 come to call the deceased and she went with him. It is further alleged that informant tried to search her, but she was not traced. On 17.08.2013, there was hulla that a dead body in a bag is lying on the bank of river and when the bag was opened, the dead body of the deceased was found.
Learned counsel for the petitioners submits that from bare perusal of the case-diary, it appears that save and except suspicion, there is nothing specific against the petitioners. Hence, having regard to the facts and circumstances of the case, the petitioners above named are ordered to be released on bail on furnishing bail bonds of Rs.10, 000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Katihar, in connection with Kadwa P.S.
