The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.
The prosecution case is that the petitioner being the Assistant Godown Manager-cum-Transporting Incharge of the F.C.I. failed to explain that in what circumstances the four trucks loaded with rice proceeded on 26.09.2015 from F.C.I., godown, Phulwarisharif to Punpun godown of F.C.I. on 26.09.2015, though other four trucks loaded with wheat reached to the destination. It is submitted by the learned counsel for the petitioner that four trucks of rice was supposed to reach in the evening at 9.30 P.M. on 27.09.2015, but could not reach, when
Patna High Court Cr.Misc. No.6409 of 2016 (2) dt.11-02-2016 the First Information Report was lodged though the trucks were intercepted and seizure was made at 10.30 P.M same day. Considering the fact that the consignment ultimately reached to the F.C.I. godown with few hours delay and there is accusation of misplacing of grains, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurhi in connection with Punpun P.S. Case No. 223 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
